Terms of Service

1. Acceptance of Terms

Welcome to Bizzy Day. These Terms of Service ("Terms") govern your access to and use of the Bizzy Day web application, marketing website, and related services (collectively, the "Services"), operated by Bizzy Day ("we," "our," or "us").

By creating an account, accessing, or using our Services — whether as a tradesperson or a customer — you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with any part of these Terms, you may not access or use our Services. These Terms constitute a legally binding agreement between you and Bizzy Day.

We may modify these Terms at any time. Continued use of the Services after changes are posted constitutes your acceptance of the modified Terms.

2. Eligibility & Accounts

2.1 Age Requirements

You must be at least 18 years old to create a tradesperson account or enter into a subscription. Customers using the search functionality must be at least 13 years old. By using our Services, you represent and warrant that you meet these requirements.

2.2 Tradesperson Accounts

When creating a tradesperson account, you agree to:

  • Provide accurate, complete, and current information about yourself and your business
  • Keep your account information up to date, including contact details and trade type
  • Keep your password secure and confidential
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorised access or security breach
  • Only list genuine trades and services that you are qualified and legally permitted to carry out

2.3 Customer Use

Customers do not need to create an account to search and view tradesperson profiles. No registration is required. Customer use is subject to the general conduct rules in Section 8.

3. Subscriptions & Payments

3.1 Subscription Plans

Bizzy Day offers the following paid plans for tradespeople:

  • Standard — £6.99/month: public listing, availability calendar, job management, receipts, quotes, invoices, route optimiser, Google Calendar sync, and more
  • Pro AI — £9.99/month: everything in Standard plus AI-powered Voice-to-Quote, Voice-to-Pre-Quote, Receipt OCR, Debt Chasing, and Smart Search
  • Featured Listings — £5/month per postcode district: a standalone product that makes you appear at the top of search results for chosen districts. It can be purchased with or without a Standard or Pro AI subscription; without an active subscription, your availability calendar is not shown to customers

Customer search is always free and requires no subscription.

3.2 Billing & Payment

All payments are processed by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring monthly basis. Prices are shown inclusive of any applicable VAT.

Subscriptions automatically renew each month until cancelled. You can manage or cancel your subscription at any time via the Subscription screen within the app or via the Stripe Customer Portal.

3.3 Cancellation & Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you retain access to paid features until that date. We do not offer partial-month refunds.

Upon cancellation, your public profile is immediately hidden from customer search results, but your data is preserved. You may resubscribe at any time to restore your listing.

3.4 Plan Changes

Upgrading from Standard to Pro AI takes effect immediately and a prorated charge is applied for the remainder of the billing period. Downgrading from Pro AI to Standard is deferred to the end of your current billing period.

3.5 Featured Listings

Featured Listings are billed monthly per postcode district, independently of any Standard or Pro AI subscription. Removing a featured listing takes effect immediately; no refund is issued for the unused portion of the billing period.

3.6 Price Changes

We reserve the right to change subscription prices. We will give you at least 30 days' notice of any price change. Continued use after the notice period constitutes acceptance of the new pricing.

4. Tradesperson Obligations

As a tradesperson on Bizzy Day, you agree to:

  • Maintain an accurate and up-to-date public profile, including trade type, location, and contact details
  • Keep your availability calendar reasonably current so that customers see genuine availability
  • Only link to Checkatrade and Trustatrader profiles that belong to you
  • Hold all relevant qualifications, licences, and insurances required to carry out the trades you advertise
  • Comply with all applicable UK laws and regulations, including those relating to construction, health and safety, and consumer protection
  • Not create misleading or false profile information
  • Handle customer contact details and any personal data received through the platform in accordance with UK data protection law (UK GDPR)

Bizzy Day is a discovery and management platform. We do not vet, endorse, or guarantee the quality, safety, or legality of any tradesperson's work. Any contract for services is directly between the tradesperson and the customer.

5. Customer Use

Customers use Bizzy Day to discover available tradespeople. By using the search functionality, you agree to:

  • Use search results for genuine enquiries only
  • Not use contact details obtained through Bizzy Day for spam, harassment, or commercial purposes unrelated to the services advertised
  • Understand that availability information is provided in good faith by tradespeople and is not guaranteed to be real-time accurate

Bizzy Day does not take any commission, facilitate payments, or act as an agent in any transaction between customers and tradespeople. All contracts, payments, and disputes are solely between the parties involved.

7. AI Pro Features

Pro AI subscribers have access to AI-powered features powered by Anthropic Claude and OpenAI Whisper. By using these features, you acknowledge and agree that:

  • Voice recordings, receipt images, and job data are transmitted to third-party AI providers (Anthropic and OpenAI) for processing
  • AI-generated content — including quotes, email drafts, and search results — is provided for your convenience and must be reviewed before use
  • We do not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated output
  • You are solely responsible for any quotes, invoices, or communications you send to customers based on AI-generated drafts
  • AI features process data in accordance with our Privacy Policy and the respective third-party providers' terms

8. Prohibited Conduct

You agree not to use the Services to:

  • Violate any applicable UK or international laws or regulations
  • Provide false, misleading, or deceptive information in your profile or calendar
  • Harass, abuse, threaten, or intimidate other users or Bizzy Day staff
  • Impersonate any person or entity
  • Create multiple accounts to circumvent suspensions or restrictions
  • Scrape, crawl, or systematically extract data from the Services without our written consent
  • Reverse engineer, decompile, or attempt to access the source code of our Services
  • Introduce viruses, malware, or any other harmful code
  • Interfere with or disrupt the integrity or performance of the Services
  • Use automated systems or bots to interact with the Services without permission
  • Resell or commercially exploit access to the Services
  • Use contact details obtained from the platform for purposes other than engaging with advertised services

9. Third-Party Services

Our Services integrate with the following third-party providers. Your use of these integrations is subject to their respective terms and privacy policies:

  • Stripe — payment processing (stripe.com/gb/legal)
  • Supabase — database, authentication, and file storage
  • Anthropic — Bizzy Day AI processing for Pro AI features
  • OpenAI — Whisper audio transcription for Voice-to-Quote and Voice-to-Pre-Quote
  • Google — Calendar API (bidirectional sync) and Routes API (route optimiser)
  • Apple — Sign In with Apple authentication
  • postcodes.io / Nominatim — open postcode and location data (no personal data transmitted)

We are not responsible for the content, practices, availability, or policies of third-party services. Links to Checkatrade, Trustatrader, and other external sites on tradesperson profiles are provided by tradespeople and we are not responsible for their content.

10. Intellectual Property

10.1 Bizzy Day's Rights

All rights, title, and interest in the Services — including software, design, graphics, text, and trademarks — are owned by or licensed to Bizzy Day. You may not copy, modify, distribute, sell, or reverse engineer any part of our Services without our express written permission.

10.2 Your Content

You retain ownership of the content you upload to Bizzy Day — including profile information, job data, receipts, quotes, and invoices ("Your Content"). By posting Your Content, you grant Bizzy Day a limited, non-exclusive, royalty-free licence to store, display, and process Your Content solely to provide the Services to you.

10.3 Content Standards

Your Content must not:

  • Infringe any third-party intellectual property rights
  • Contain false, misleading, or deceptive information
  • Include unlawful, offensive, or defamatory material
  • Contain viruses or malicious code

11. Privacy

Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our data practices as described in the Privacy Policy.

As a tradesperson, you are responsible for handling any personal data you receive from customers (names, contact details, addresses) in accordance with UK data protection law, including the UK GDPR. You act as an independent data controller in respect of that data.

12. Termination

12.1 Your Rights

You may cancel your subscription and delete your account at any time via the Settings screen. On account deletion, your personal data and content are permanently removed within 30 days, subject to our Privacy Policy and any legal retention obligations.

12.2 Our Rights

We reserve the right to suspend or terminate your account at any time, with or without notice, if you:

  • Violate these Terms or our content standards
  • Engage in fraudulent, abusive, or illegal activity
  • Provide materially false profile information
  • Fail to pay subscription fees
  • Pose a risk to other users or to the integrity of the Services

12.3 Effect of Termination

On termination, your right to use the Services ceases immediately and your public profile is removed from search results. Provisions that by their nature survive termination — including intellectual property rights, disclaimers, limitation of liability, and governing law — remain in effect.

13. Disclaimers & Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

  • The Services will be uninterrupted, error-free, or free from security vulnerabilities
  • Tradesperson availability information will be accurate or up to date at all times
  • AI-generated quotes, emails, or search results will be accurate, complete, or fit for purpose
  • Calendar sync data from third-party services will be error-free
  • The Services will meet your specific business requirements

Bizzy Day is a marketplace platform only. We do not vet, accredit, endorse, or take any responsibility for the quality, safety, or conduct of any tradesperson listed on the platform. Any contract for work is solely between the tradesperson and the customer.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIZZY DAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

This includes, without limitation, damages arising from:

  • Inaccurate or outdated availability information
  • Errors in AI-generated content (quotes, invoices, emails)
  • Disputes between tradespeople and customers
  • Unauthorised access to your account
  • Interruption or unavailability of the Services
  • Loss of data, revenue, or business opportunity

Our total aggregate liability to you for all claims arising from the Services shall not exceed the greater of £100 or the total subscription fees you paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Bizzy Day, its officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the Services in breach of these Terms
  • Your Content, including false or misleading profile information
  • Your violation of any applicable law or third-party rights
  • Any dispute between you and a customer or tradesperson
  • Your use of AI-generated outputs without appropriate review

16. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before bringing a formal claim, we encourage you to contact us at legal@bizzy.day so we can attempt to resolve the matter informally. We will aim to respond within 14 days.

If you are a consumer, nothing in these Terms affects your statutory rights under English law.

17. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page
  • Post the updated Terms on this website
  • Notify subscribed tradespeople by email for significant changes

Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Services and may delete your account.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bizzy Day regarding the Services and supersede any prior agreements.

18.2 Severability

If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary and the remaining provisions shall remain in full effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

18.4 Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign these Terms to any affiliate or successor without restriction.

18.5 Force Majeure

We are not liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including internet outages, third-party service failures, or acts of God.

18.6 Relationship

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Bizzy Day. Tradespeople are independent contractors, not employees or agents of Bizzy Day.
